The Learner course will include the full Practical syllabus as laid
down by the DSA in their publication The Official Driving Test. The
number of lessons required will depend on each Student's ability and progress.
As a guide, many Students will find they need between 20 and 40 lessons.
Students must ensure that they pass the compulsory Theory Test before they can
be entered for the Practical test.
The PassPlus course will include the full requirements of the scheme. This
course requires a minimum of 6 lessons to be completed with a minimum of 5
Practical sessions.
Advanced driver training, motorway training and refresher training will be as
agreed or as required by any advanced syllabus being followed.
Each lesson will comprise 60 minutes, including any administration. The
Instructor will not use your lesson for any other form of business, personal or
otherwise.
Payments must be made in advance of training. A deposit of 50%
is required to book a course. If the course commences within 4 weeks, full
payment is required. If payment is made via PayPal, then no instruction will be
provided until cleared funds have been received.
Please note: the deposit or any subsequent training fees paid
are not refundable in the event that you decide to cancel the training. This
does not affect your statutory rights to be provided with the goods or services
you have bought (see YOUR STATUTORY RIGHTS).
Your instructor will be a QUALIFIED Driving Standards Agency Approved Driving Instructor(CAR). The instructor is a member of the Driving Instructor's Association(DIA) and the Motor Schools Association(MSA) and we comply with all the relevant Codes of Conduct.
The vehicle will be well maintained, clean and tidy. It is fitted with Dual Controls and is fully insured for driving tuition. NO SMOKING is allowed in the vehicle.
The student must hold a current, valid driving licence (provisional or full ) which must be produced on, or in advance of, their first lesson. The student must also check that they can comply with the eyesight requirements of the Driving Test using glasses/contact lenses if normally worn. Failure to meet this requirement will lead to lesson cancellation and the loss of that lesson fee.
It is a legal requirement for you to notify DVLA of certain medical conditions. If you are in any doubt about a medical condition, the Student must discuss the matter with their GP or contact DVLA for clarification. No driving instruction will be given until the matter has been clarified.
Provided the Instructor has sufficient warning of cancellation
by the Student and can obtain additional work to cover the cancelled lesson,
then no penalty will be incurred. However, at the Instructor's discretion, all
lessons cancelled within 48 hours will be charged at up to the full lesson rate.
The Instructor reserves the right to postpone/shorten lessons if he feels that
the weather or road conditions are unsuitable or dangerous for a particular
Student's ability. The Instructor's decision in these matters is final. The
Instructor cannot be held liable for any costs incurred as a result of
cancellation/postponement.
Bookings: You or your Instructor may book your driving test. If
the Instructor books your test, than all fees for the test are payable to LGPSOM
and the contract for your test remains with LGPSOM. If any fees are outstanding
14 days before your test, then we reserve the right to cancel your test and use
any refund to offset any outstanding debts. Driving test bookings always take
priority over other lessons. Therefore, your lesson may be postponed to allow
for another Student's test. Test appointments must be notified to you Instructor
as soon as possible, otherwise he may not be able to guarantee the availability
of the training vehicle.
Use of vehicle: In the interests of Student and Public safety,
your Instructor reserves the right to withhold the use of the training vehicle
for the test if, in his opinion, your standard of driving is potentially
dangerous. The use of the vehicle for your test will be subject to normal
lesson charges which are in addition to the DSA test fee.
Test Cancellation: Four clear working days notice of
cancellation or postponement (not including weekends and Public Holidays) is
required. Failure to provide the required notice will result in the loss of your
test fee. Your Instructor cannot be held liable for the cancellation or
postponement of tests by the DSA. However, he will do all that is possible to
arrange another test as quickly as possible and help you to reclaim expenses
from the DSA where appropriate.
Students are advised to be punctual for their appointments. All appointments should be recorded in your appointment card. The Instructor will normally wait for a maximum of 15 minutes, after which the lesson would be abandoned and the fee forfeited or become due for payment. It may be that the Instructor is delayed due to unforeseen circumstances. Any lesson time lost as a result would be made up, either at the end of the lesson if possible or at a later date. Any lost time must be recorded on your appointment card.
In the interest of comfort and safety, Students are advised to wear suitable footwear and clothing that does not restrict movement. Students must also take note of any medication they are taking that may affect their ability to drive safely and advise their Instructor accordingly before taking any lesson booked. Failure to notify the Instructor of any medical condition, or medication being taken, may result in the termination of this agreement and the loss of any monies prepaid.
In the event of a complaint, all efforts must be made to resolve the problem with your Instructor. In the event that a complaint cannot be resolved then it may be referred to the DIA, MSA or DSA.
Nothing in these terms and conditions will reduce your statutory rights relating to faulty or misdescribed goods or services provided. The Instructor has a statutory obligation to provide you with goods and services fit for the purpose for which they were bought and as described. If you have any doubts about your rights, please contact your local Trading Standards Office or Citizen's Advice Bureau.
